Brolo Cigar Co. ("Brolo," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through brolocigars.com and related marketing, wholesale-account, and communication channels (collectively, the "Services"), how we use and share it, and the choices available to you. By using the Services, you agree to this Privacy Policy.

Brolo sells cigars on a wholesale and trade basis to licensed retailers and distributors. We do not sell tobacco products directly to individual consumers through this website. This policy is written to cover every type of visitor e.g. retail consumer, retailer, distributor, or job applicant who might interact with us.

1. Age Restrictions and Children's Privacy (COPPA)

The Services are intended for individuals twenty-one (21) years of age or older and are not directed to anyone under the age of 21. We do not knowingly collect personal information from anyone under 21, and we do not knowingly collect personal information from children under the age of 13. If we learn that we have inadvertently collected personal information from a child under 13, we will delete it as soon as reasonably possible. Visit the Federal Trade Commission website (www.ftc.gov) for more information about the Children’s Online Privacy Protection Act (COPPA).

2. Information We Collect

We may collect the following categories of information:

  • Contact information: name, business name, mailing address, email address, and phone number, such as when you submit a wholesale/trade inquiry, contact us, or sign up for our mailing list.

  • Trade account information: retailer or distributor license details, order history, and related business information, for customers who purchase from Brolo on a wholesale basis.

  • Age-verification information: date of birth or age attestation, collected by us or by a third-party age-verification provider, to confirm you meet the 21+ requirement before granting access to parts of the Services.

  • Technical and usage information: IP address, browser type, device identifiers, pages viewed, and similar data collected automatically through cookies and similar technologies (see Section 5).

  • Communications: the content of emails, contact-form submissions, or other messages you send us.

We do not knowingly collect payment card data directly. Any payment processing available through Brolo Cigar Co. (for example, wholesale account deposits) is handled directly through our sales portal using a PCI DSS compliant third-party payment processor; Brolo does not store full payment card numbers on our own systems.

3. How We Use Information

We use the information we collect to:

  • Verify age and eligibility to access the Services;

  • Process and manage wholesale/trade account inquiries and orders;

  • Respond to questions and provide customer service;

  • Send marketing and promotional communications, where you have opted in;

  • Maintain, secure, and improve the Services;

  • Comply with applicable federal, state, and local law, including tobacco-control, tax, and licensing requirements; and

  • Enforce our Terms of Use and protect the rights, property, and safety of Brolo and others.

4. How We Share Information

We do not sell your personal information to unaffiliated third parties for their own marketing purposes. We may share information with:

  • Service providers who host our website, send email communications, verify age, process payments, or provide similar services on our behalf, under obligations to protect your information and use it only to perform services for us;

  • Licensed retail and distribution partners, where necessary to fulfill a trade relationship or connect you with a local retailer;

  • Government or regulatory authorities, where required to comply with law, tobacco-tax reporting, or a valid legal request; and

  • A successor entity, in the event of a merger, acquisition, or sale of some or all of Brolo's assets.

5. Cookies and Online Tracking

We and our service providers use cookies and similar technologies to operate the Services, remember your age-verification status, and understand how visitors use our website. We may use analytics and, where applicable, advertising technologies that rely on cookies. You can control cookies through your browser settings; blocking cookies may affect site functionality (including age-gate persistence).

We do not currently respond to browser "Do Not Track" signals, as no common industry standard for such signals has been adopted. If we participate in interest-based advertising, you may be able to opt out through the Digital Advertising Alliance (www.aboutads.info/choices) or the Network Advertising Initiative (www.networkadvertising.org/choices).

6. Your Choices

You may:

  • Unsubscribe from marketing emails at any time using the link in any message we send;

  • Request access to, correction of, or deletion of your personal information, subject to the exceptions described below; and

  • Contact us with privacy questions using the information in Section 11.

We may be unable to delete or stop using information that we are required to retain for tax, regulatory, licensing, fraud-prevention, or legal-compliance purposes.

7. California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, "CCPA"), gives you the right to request access to, correction of, or deletion of the personal information we hold about you, and the right not to be discriminated against for exercising these rights. Brolo does not sell or share personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. To make a request, or to designate an authorized agent to do so on your behalf, contact us using the information in Section 11. We will take reasonable steps to verify your identity before responding, and we may ask for additional information to do so.

8. Payment Security (PCI DSS)

Where the Services involve payment processing, Brolo relies on third-party payment processors that maintain compliance with the Payment Card Industry Data Security Standard (PCI DSS). We do not store complete payment card numbers, and card data is transmitted through encrypted, processor-hosted channels rather than through Brolo's own servers wherever technically possible.

9. Data Retention and Security

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this policy, including to meet our tax, licensing, accounting, and legal obligations, after which it is deleted or de-identified. We maintain administrative, technical, and physical safeguards designed to protect personal information against loss, misuse, and unauthorized access; however, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with a revised "Last Updated" date. Material changes will be highlighted at the top of this page or otherwise communicated as required by law. Continued use of the Services after a change takes effect constitutes acceptance of the updated policy.
